Affiliate Program Agreement

Please read this agreement carefully before registering and using the eBladeStore.com service as an affiliate. By signing up for the eBladeStore.com affiliate program, you indicate your acceptance of this agreement and its terms and conditions.

1. Joining the Program
By filling out the signup form you will become an affiliate upon approval by eBladeStore.com and are bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise the eBladeStore.com website to receive a commission on products purchased by you referring individuals.

2. Revocation of Associate Status
Your affiliate application and status in the program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (False claims, misleading hyperlinks)
• Spamming (mass email, mass newsgroup posting, etc...)
• Advertising on sites containing/promoting illegal activities
• Violation of intellectual property rights.

2a. Brand Representation
Affiliates may not represent themselves as eBladeStore.com sites or as a dealer for any of the brands we carry. Affiliate websites should not copy or resemble the look and feel of eBladeStore.com sites or create the impression that Affiliate site is a eBladeStore.com site. Affiliates may not serve any eBladeStore.com site products through their shopping cart. Framing of any eBladeStore.com site is not permitted.

2b. Spam and Electronic Messages
Under no circumstances shall Affiliate send commercial electronic mail messages as defined in the new Federal spam law, the CAN-SPAM Act of 2003 [the “Act”], with respect to eBladeStore.com's Affiliate Program. For clarification, this does not prohibit Affiliate from sending transactional or relationship messages as defined in the Act. In addition, except as expressly authorized by eBladeStore.com, any and all electronic messages initiated or sent by Affiliate or on Affiliate's behalf must identify Affiliate as the sender and may not suggest or imply, or mislead or be likely to mislead a recipient into believing that a eBladeStore.com site is the sender or sponsor of, or has procured Affiliate to send, such electronic messages. To be clear, Affiliate may not use a return address, subject heading, header information or message contents that misleads or confuses or is likely to mislead or confuse a recipient as to Affiliate being the sender.

3. Affiliate Links
You may use graphic and text links both on your website and in emails. eBladeStore.com may also be advertised "offline" in classified ads, television, magazines and newspapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate according to the conditions in Two above.

3a. Content
Affiliates may use eBladeStore.com site content (including but not limited to reviews, copy, and images) exclusively to promote eBladeStore.com site. Affiliates may not utilize eBladeStore.com site content on any page that promotes any other company.

4. Affiliate Tracking
When a web surfer clicks through your affiliate link, a cookie is set in their browser that contains your affiliate id. Also, their IP address is tracked in the database along with your affiliate user name. When this person decides to buy a product, the script will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase later in time and the commission will still be awarded if the cookie is present in their browser and/or the are using the same IP address as the one logged in the database.

5. Terms of Agreement
These terms will begin upon your signup and approval with the affiliate program and will end when your affiliate account is terminated. The terms of this agreement may be modified by eBladeStore.com at any time. If any modification to the terms is unacceptable to you, your only choice is to terminate your affiliate account. Your continuing participation in the program will constitute your acceptance of any change.

6. Liability
eBladeStore.com will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, and any results of "intents of harm" to the program or the eBladeStore.com website. eBladeStore.com does not make any expressed or implied warranties with respect to the affiliate program and/or products sold at this site. We make no claim that the operation of the affiliate program and our website will be error-free and eBladeStore.com will not be liable for any interruptions or errors.

6a. Voids/Reversals/Product Returns
A "Void" is executed by eBladeStore.com as a means to reverse the commission given to a particular affiliate on qualified sales. Voids may be the result of (i) canceled sales; (ii) product returns; (iii) duplicate or repeat errors; (iv) non-bona fide Transactions; (v) non-receipt of Payment from Customer; (vi) Refund of payment to customer; (vii) failure of affiliate to comply with the Terms of Agreement set forth by eBladeStore.com and the affiliate.

By filling out this form you acknowledge that you have read the terms and conditions, understand, and agree with them.
